The Jones Act is a federal statue that allows an injured seaman to file a suit directly against their employer. It is a very significant statue. It is a federal statue. It gives him significant rights. The injured seaman is allowed to file what is called a tort lawsuit against the employer. They can seek all damages including pain and suffering, lost wages, medical expenses, and loss of fringe benefits. It is different than a worker's compensation statue, which would tend to limit the employee to a set amount of medical payments and a set amount of compensation. The Jones Act allows the employee to file a much larger lawsuit and we would like to focus on those cases to help injured seamen.
