The Longshore Act is a federal act that applies to injured workers who are working near the water. Their job must be maritime in nature but they do not qualify for seaman status under the Jones Act. Typically if the Longshore Act will apply to harbor workers, it also applies to fixed platform workers in the Gulf of Mexico. The significant thing for longshore employees is to know that they do have third party rights against any third party who might be at fault for their injury.
