Generally under Louisiana Law, a claim for medical malpractice must be filed within one year from the date of the malpractice; however, if you discover the act of malpractice after the one year, you have one year to file from the date of discovery of this act of malpractice; however, this claim must be filed within three years of the date of the medical malpractice.
